By using our coaching services, you agree to the following terms and conditions:
 

1. Scope

These General Terms and Conditions (GTC) govern the contractual relationship between Claude Bravi and his clients for coaching services, artist management, and workshop creation. They apply to all services provided, whether in person, online, or through any other means of communication.

2. Services and Liability

The provider commits to delivering coaching, artist management, training, and workshop services professionally and in accordance with applicable standards. However, no specific result or guaranteed success is promised. The provider is not liable for failure to achieve the client's goals. Liability for indirect damages, such as loss of income or opportunities, is excluded, except in cases of gross negligence or intent.

3. Confidentiality and Data Protection (Swiss DPA and GDPR)

The provider is committed to maintaining the confidentiality of information shared by the client. Personal data is processed in accordance with the Swiss Data Protection Act (DPA) and the General Data Protection Regulation (GDPR).

  • Type of data collected: Only information necessary for the provision of services (e.g., name, contact details, preferences) is collected.

  • Purpose of data processing: Data is collected and processed solely for the purpose of providing the agreed-upon services.

  • Client rights: Clients may request access, correction, or deletion of their personal data at any time and may object to its processing.

  • Data sharing: Data will not be shared with third parties unless the client provides explicit consent or if required by law.

4. Financial Terms

  • Prices: Service prices are provided on the provider’s website or communicated to the client before the contract is signed.

  • Payment: Payment is made according to the terms agreed upon in the contract (e.g., bank transfer, credit card). Typically, payment is due before the start of services unless otherwise agreed.

  • Late payment: In case of late payment, the provider reserves the right to suspend services until payment is settled. Reminder fees may be applied.

5. Cancellation and Service Changes

  • Cancellation by the client: Sessions can be canceled with [e.g., 24 or 48 hours] notice. After this period, the full service fee will be charged.

  • Cancellation by the provider: The provider may cancel or reschedule sessions due to unforeseen events or force majeure. The client will be informed promptly, and a new date will be agreed upon.

  • Service changes: Changes must be mutually agreed upon in writing by both parties.

6. Intellectual Property

All content, tools, and documents provided within the scope of coaching or management services are protected by copyright. Clients agree not to reproduce, distribute, or use these materials for commercial purposes without prior written consent from the provider.

7. Right of Withdrawal (Online Commerce)

For online bookings, clients have the right to withdraw from the contract within 30 days of order confirmation without providing a reason. The withdrawal must be made in writing (via email or postal mail). This right applies exclusively to services booked online.

8. Contract Termination

  • Individual sessions may be terminated by either party with 24 hours' notice.

  • Subscriptions and long-term agreements may be terminated with 30 days' notice.

  • Workshops and artistic coaching appointments require 5 days' notice for cancellation.

  • Payments already made are non-refundable, and the client remains responsible for services provided up to the termination date.

9. Force Majeure

The provider is not liable for delays or failures in performance due to force majeure, such as natural disasters, pandemics, strikes, or government actions.

10. Applicable Law and Jurisdiction

These GTC are governed by Swiss law. In the event of disputes, the parties agree to seek an amicable resolution first. If no agreement is reached, the competent court is located in Chur, unless otherwise mandated by law.

11. Changes to the General Terms and Conditions

The provider reserves the right to amend these GTC at any time. The new terms will take effect upon publication on the provider’s website. Clients will be notified of significant changes. If no objection is made within 30 days, the changes are considered accepted.
